Health Product Claims in Thailand: FDA Rules & Script Liability
Key Points
- Thailand's FDA revised its cosmetics advertising manual in 2024 and named influencers among those who have to follow it
- A Consumer Council proposal published in September 2026 would widen the Food Act definition of a food business operator to cover influencers and script writers
- Brands should clear claim wording centrally and record who wrote each health or beauty script
Thai regulators already treat creator reviews of health products as advertising
The Thai FDA republished its cosmetics advertising manual in 2567 (2024) and asked everyone involved in cosmetics advertising, influencers included, to study it and follow it closely, warning that violations can lead to prosecution [1]. What the manual demands is ordinary enough: information has to be accurate, and claims that exaggerate or mislead are not allowed [1].
The awkward part for an overseas brand is the route a case takes. Enforcement usually starts with a report rather than an audit. The agency publishes the 1556 hotline, a Line account and an email address for anyone who wants to flag an advertisement, so a competitor, a rival creator or an annoyed buyer can open the file [2].
That puts a brand's exposure in wording it often never sees. The line that causes trouble is usually not in the approved caption but in what the creator adds while filming: the before-and-after framing, the promise that something clears in a week, the word "treat" where the brief said "care". Thai regulators read that sentence as advertising, and the brand behind the product is the party with something to lose.
A September 2026 proposal would put script writers inside the liable group
The Food Act B.E. 2522 is 47 years old, and in September 2026 the Consumer Council of Thailand set out what it wants changed [3]. Two of the proposed amendments reach campaign work directly. The definition of advertising media would widen to cover electronic and digital platforms, and the definition of a food business operator would widen to take in those who advertise food, not only those who make or sell it [3]. On that reading, the influencer and the person who wrote the script sit inside the regulated group. The proposal discusses penalties of imprisonment and fines without naming amounts [3].
This is a consumer body's proposal rather than enacted law, and it may change before it reaches the statute book. Preparing for it costs little, because what it asks for is record keeping: if authorship becomes something a regulator can ask about, an agency has to be able to say who wrote each line.
Few brands could answer that today. Scripts arrive as a shared document, the creator rewrites half of it on the day, and the version that was approved survives as a screenshot in a chat thread. Arguably that is worth fixing whatever happens to the amendment.
Skincare is the largest digital spender in Thailand, so the exposure is concentrated
DAAT expects Thai digital ad spend to fall 0.3% in 2026, to 32,145 million baht, the first decline in the fourteen years it has run the survey [4]. Skincare moves the other way. The category is forecast at 6,185 million baht, up 16% on 2025, close to a fifth of all digital spend and the largest single category by some distance (Chart 1) [4].
Creator activity concentrates in the same places. Food and beverage together with fashion and beauty account for 54.4% of Thai influencer marketing [5]. The categories that take the most creator budget are the categories where one sentence can breach the cosmetics rules or the Food Act.
For a marketer planning a Thai launch, that overlap decides where review time is worth spending. A claim library built for skincare and supplements covers most of what is at risk in the plan, while the same hours spread evenly across every category cover much less. It is also the cheaper order of work. A takedown in the biggest-spending category wastes the most media, and in a year when the market as a whole is not growing, that loss is harder to make back.

Approve the wording centrally and name the author on every script
Three habits cover most of the exposure. Keep a claim library per SKU, cleared against FDA rules before any brief goes out, so creators pick from approved wording instead of inventing it [1]. Record who drafted each script and keep the approval trail with it [3]. Put local regulatory review, not only brand marketing, on health and beauty scripts before filming.
The first library is the painful one, since it has to be written from the product file rather than from the deck. After that it is a lookup, and it shortens the approval round instead of adding one.
The Consumer Council's proposal may or may not become law, and the penalty amounts in it are not fixed [3]. The FDA manual is already in force and already names influencers among those who have to follow it [1]. A brand that can name the author of every line it published, and show where the wording was cleared, is arguably in reasonable shape under either version of the rules.
